One Application must be filled out COMPLETELY by each adult applicant over the age of 18. When supplying names, give complete and full names including full middle names, if any. Sign on 2nd page with your complete and full signature and list both your work and your home phone numbers. Do not give pager numbers. When supplying addresses, give complete addresses including apartment numbers, cities, states and zip codes.

DISCLAIMER

This application is made for the purpose of procuring rental of herein described premises, and for credit clearance.

Everything that I have stated in this application is correct to the best of my knowledge. I understand that you will retain this application and all supporting documents whether or not it is approved. I hereby authorize Caruso Affiliated, through its designated agent and its employees to check my credit, employment, and rental history, and to answer questions about my credit experience. I understand that should I lease an apartment, Caruso Affiliated, and its agents shall have a continuing right to review my credit information, rental application, payment history and occupancy history for account review purposes and for improving application methods.

I hereby agree to release and hold harmless Caruso Affiliated, its agents, servants and employees from any and all liability, legal proceedings and costs including attorney's fees arising out of either the verification of the information contained on this application form or the release of this information to other parties.

All of the above data and information set forth herein including, but not limited to, the statement of my income and financial condition is warranted to be true and accurate and to fully and correctly state my financial condition as of the date of this application. I also covenant and agree to notify you of any changes in the status of any of the aforementioned items during the period of my tenancy.

The Application Deposit is fully refundable only if written notice revoking this offer is received by the owner/manager within three (3) days. However, if owner/manager has duly accepted this offer to rent, this Application is then to be treated as a completed contract to rent/lease THE PROPERTY and Applicant's attempted revocation after three (3) days shall be deemed a breach of contract. In addition, the failure of Applicant to timely pay all sums due and execute the Rental Agreement/Lease shall be deemed a breach of contract. In either case, the Application Deposit shall then become nonrefundable to the extent that such deposit may be withheld and used to offset and recompense any and all losses incurred as a result of such breach. Otherwise, the Application Deposit will be applied towards the Security Deposit.

It is agreed that this deposit will be held by Caruso Affiliated to reserve the premises listed herein for applicant's occupancy. The deposit will be nonrefundable after three (3) days except in the event applicant is not approved or possession of said premises cannot be delivered to applicant on the date specified.

It is also understood that the application fee is not a deposit and will not be refunded or applied to rent if applicant is approved or denied. This fee is for the cost to process the application.

8500 BURTON RESIDENT SELECTION CRITERIA

Overall Standards

Fair Housing: This community does not discriminate on the basis of race, color, sex, religion, handicap, familial status, sexual orientation, national origin or any other class protected by applicable law.

Occupancy Standards: No more than two people per bedroom may occupy the apartment, unless there are special circumstances approved by Landlord. Infants up to twenty-four (24) months old are not considered for occupancy purposes.

Identification: All visitors must present a valid driver´s license or other U.S. or state-government issued photo identification in order to view the community. Non-U.S. citizens must present a valid passport or valid visa.

Application Standards and Process

Application for Residency: An Application for Residency must be completed for each applicant who will be living in the apartment and who has reached the age of majority under state law, which in most states is 18 years or older. Application fees, if applicable, will be collected before an application can be processed.

Investigations Standards: Landlord (or its designates) may conduct an investigation of applicant, including thorough personal interviews with applicant's current and/or prior landlord(s), employer(s), and/or others with whom applicant is acquainted. These inquiries may include information regarding applicant's character, general reputation, personal characteristics, and mode of living, credit report, and criminal background. Landlord will attach a summary of applicant's rights under the Fair Credit Reporting Act to applicant's application.

Income History: Applicants must have a gross income source that can be verified and meets the minimum income requirements for the apartment being leased which is determined by multiplying the monthly rent by a specified number of months as determined by the community. Applicants may be required to provide income verification, including a pay stub, a letter from an employer, the most recent W2, the most recent tax return and/or certified verification from company accountant or bank. In instances where sufficient income requirements cannot be met, this community may elect to accept a co-applicant.

Credit History: 8500 Burton may investigate and verify credit history. Landlord evaluates credit history information with a scoring method that weighs the indicators of future rent payment performance, but Landlord retains the right to reject an application no matter an applicant´s ultimate scoring. An unsatisfactory credit report can disqualify an applicant from renting an apartment, including one that reflects past or current bad debts, late payments or unpaid bills, liens, judgments or bankruptcies. If an applicant is rejected for poor credit history, the applicant will be given the name, address and telephone number of the credit reporting agency that provided the credit report but not be told the content of the credit report. An applicant rejected for unsatisfactory credit is encouraged to obtain a copy of the credit report from the credit reporting agency, correct any erroneous information that may be on the report, and resubmit an application.

Criminal History: Applicants, occupants and guarantors will not be accepted if they do not satisfy the criminal history inquiries required by or background investigation allowed by the residency application. However, Landlord does not guarantee or represent that residents and/or occupants currently residing at the community qualify under the criminal background criteria required by the residency application. 8500 Burton maintains a strict corporate policy prohibiting registered sex offenders from residing within our communities. This community reserves the right to investigate lists of registered sex offenders in any manner including online, in newspapers or by contacting state agencies.

Rental History: Information regarding payment and rental history of each applicant will be collected to verify tenancy. Any applicant who has been previously evicted by a court of law will not be accepted.

Employment History: 8500 Burton may confirm employment and reported salary level.

Pet Policy & Restrictions: The pet’s maximum adult weight is fifty (50) pounds. The following breeds are not permitted: Bull Terrier, American Staffordshire Terrier, Presa Canarios, Akitas, Wolf Hybrids, Huskies, Pit Bull, German Shephard, Chow Chow, Dalmatian, Doberman Pinscher, Great Dane, Siberian Husky, Rottweiler, Alaskan Malamute or any mixed breed thereof.
